Waive the second reading, except by title, and adopt Ordinance No. 1090 amending Section 13.13 of Chapter 13, Article III of the Red Bluff Municipal Code to increase the general parking limit on public streets, alleys, and public ways from 24 consecutive hours to 72 consecutive hours.

SUMMARY:
Section 13.13 currently prohibits a vehicle from remaining parked on any street, alley, or public way for more than 24 consecutive hours. The proposed amendment would establish a 72-hour limit. The proposed amendment is intended to provide a more practical and enforceable standard for parking within the public right-of-way while maintaining the City's ability to address vehicles that remain parked for extended periods.
PREVIOUS COUNCIL ACTION:
On August 18, 2026, the City Council considered Ordinance No. 1090, which proposes to amend Section 13.13 of Chapter 13, Article III of the Red Bluff Municipal Code to increase the general parking time limit from 24 consecutive hours to 72 consecutive hours.
DISCUSSION:
The City's existing 24-hour parking restriction has remained unchanged since its adoption in 1947. Staff has received concerns about the practicality of the current standard, particularly the difficulty of enforcing a 24-hour parking limit in residential neighborhoods. Ordinance No. 1090 would amend Section 13.13 to prohibit a vehicle from remaining stopped or standing on a street, alley, or public way for more than 72 consecutive hours.
The amendment also provides consistency with Section 13.11 of the Red Bluff Municipal Code, which currently authorizes City personnel to remove a vehicle that has remained standing for more than 72 consecutive hours when the vehicle is in violation of a City parking regulation.
ENVIRONMENTAL REVIEW
The proposed ordinance is not a project subject to the California Environmental Quality Act (CEQA) pursuant to Section 15378(b)(5) of the CEQA Guidelines because it involves organizational and administrative activities that will not result in a direct or reasonably foreseeable indirect physical change in the environment.
CITY FISCAL IMPACT:
The proposed amendment is administrative in nature and is not anticipated to have a fiscal impact on the City's General Fund.

CITY COUNCIL ORDINANCE NO. 1090
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF RED BLUFF AMENDING SECTION 13.13 OF CHAPTER 13, ARTICLE III OF THE RED BLUFF MUNICIPAL CODE RELATING TO THE GENERAL PARKING TIME LIMIT
WHEREAS, Chapter 13, Article III of the Red Bluff Municipal Code establishes regulations governing parking on public streets, alleys, and public rights-of-way within the City of Red Bluff; and
WHEREAS, Section 13.13 currently limits the parking of vehicles on public streets, alleys, and public ways to no more than twenty-four (24) consecutive hours; and
WHEREAS, Section 13.11 of the Red Bluff Municipal Code authorizes the removal of vehicles that remain parked in violation of City parking regulations for more than seventy-two (72) consecutive hours; and
WHEREAS, the City Council has determined that increasing the general parking limit from twenty-four (24) hours to seventy-two (72) hours will better align the Municipal Code with existing enforcement authority, improve consistency within Chapter 13, and provide a more practical and enforceable parking standard for residential neighborhoods while continuing to discourage the long-term storage of vehicles within the public right-of-way; and
WHEREAS, on September 2, 2025, the City Council directed staff to prepare an ordinance amending Section 13.13 to increase the general parking limit from twenty-four (24) hours to seventy-two (72) hours; and
WHEREAS, the City Council conducted a duly noticed public hearing on the proposed ordinance and considered all oral and written testimony presented.
THE CITY COUNCIL OF THE CITY OF RED BLUFF DOES ORDAIN ON SEPTEMBER 1, 2026, AS FOLLOWS:
SECTION 1. Findings
The City Council finds that the foregoing recitals are true and correct and are incorporated herein by this reference.
SECTION 2. CEQA
The City Council finds that adoption of this ordinance is not a project under the California Environmental Quality Act (CEQA) pursuant to Section 15378(b)(5) of the CEQA Guidelines because it involves organizational and administrative activities that will not result in a direct or reasonably foreseeable indirect physical change in the environment. Alternatively, if the ordinance is determined to constitute a project, it is exempt from CEQA pursuant to Section 15061(b)(3) of the CEQA Guidelines because it can be seen with certainty that there is no possibility the ordinance may have a significant effect on the environment.
SECTION 3. Amendment to Red Bluff Municipal Code
Section 13.13 of Chapter 13, Article III of the Red Bluff Municipal Code is hereby amended to read as follows:
§ 13.13 SEVENTY-TWO HOUR PARKING.
No vehicle or part thereof shall be stopped or left standing upon any street, alley, or public way of whatever kind or description for a period of more than seventy-two (72) consecutive hours.
SECTION 4. Severability
If any section, subsection, sentence, clause, phrase, or portion of this ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council declares that it would have adopted this ordinance and each section, subsection, sentence, clause, phrase, and portion thereof irrespective of the fact that any one or more portions may be declared invalid or unconstitutional.
SECTION 5. Codification
The City Clerk, or the Clerk's designee, is authorized to make non-substantive corrections to this ordinance, including correcting section numbers, formatting, capitalization, cross-references, and typographical errors, and shall cause this ordinance to be codified in the Red Bluff Municipal Code.
SECTION 6. Effective Date
This ordinance shall take effect thirty (30) days after its adoption.
SECTION 7. Publication
Within fifteen (15) days following its adoption, the City Clerk shall certify the adoption of this ordinance and shall cause it to be published in accordance with Government Code Section 36933.
