RECOMMENDED COUNCIL ACTION:

recommendation

1.                     Adopt Resolution No. 12-2026 authorizing the submission of an application to the California Department of Justice (DOJ) Tobacco Grant Program and;

body

SUMMARY:

The California Department of Justice (DOJ) has announced the Fiscal Year 2026-27 Tobacco Grant Program, funded through Proposition 56, the California Healthcare, Research and Prevention Tobacco Tax Act of 2016. The program provides grant funding to local public agencies to support enforcement activities aimed at reducing illegal retail sales and marketing of tobacco products, including e-cigarettes, to minors and youth.

DISCUSSION:

The proposed resolution authorizes the City to apply for a $56,000 DOJ Tobacco Grant Program and positions the City to pursue external funding opportunities that may support local tobacco enforcement activities. Adoption of the resolution does not obligate the City to expend funds or implement a program unless a grant award is received and accepted.

If awarded, staff will execute the required grant agreement documents and administer the grant in accordance with DOJ requirements. Any grant-funded activities would be conducted in accordance with the approved scope of work and budget authorized by the DOJ.

Eligible activities include retailer inspections, compliance checks, minor decoy operations, retailer education, investigations, prosecutions, and related tobacco enforcement efforts. Our Code Enforcement team will take the lead in administering this program, in collaboration with the Police Department, the Tehama County District Attorney's Bureau of Investigation, and local schools.

The proposed action is not a project under the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15378, as it constitutes an administrative activity that will not result in a direct or reasonably foreseeable indirect physical change in the environment.

CITY FISCAL IMPACT:

There is no fiscal impact associated with the adoption of the resolution. If the City is successful in obtaining grant funding, eligible project costs would be reimbursed by the California Department of Justice in accordance with grant program requirements. The grant does not require a local matching contribution. Any future fiscal impacts associated with grant administration would be addressed through the grant budget and annual budget process as necessary.
